Important Notice for Telephony & AI Services

VoiceAI is a cloud communications platform that provides voice agent infrastructure. By using this service, you acknowledge that automated phone calls, call recording, and AI-generated speech are subject to federal and state regulations including the TCPA, FCC rules, and state recording consent laws. You are responsible for compliance with all applicable laws.

1. Service Description

VoiceAI provides a cloud-based communications platform that enables businesses to build, deploy, and manage AI-powered voice agents for inbound and outbound phone calls, SMS messaging, and multi-channel customer interactions. The platform includes telephony infrastructure (via Twilio), speech-to-text and text-to-speech processing (via AssemblyAI), large language model integration (via third-party LLM providers), call recording, analytics, CRM integration, and related developer tools.

VoiceAI is a Software-as-a-Service (SaaS) platform and infrastructure provider. We are not a telephone company, common carrier, or telemarketing firm. Customers use our platform to build their own applications and are responsible for the content and conduct of their agents.

2. Telephony & Call Recording Compliance

TCPA Compliance: Customers must comply with the Telephone Consumer Protection Act (TCPA), including obtaining prior express consent for automated calls, honoring Do-Not-Call (DNC) registry entries, and respecting call time restrictions (8 AM – 9 PM local time). VoiceAI provides DNC list management and call time restriction tools, but compliance is the customer's responsibility.

Call Recording Consent: Call recording is subject to state-specific consent laws. One-party consent states require at least one participant's consent. Two-party/all-party consent states (CA, FL, IL, MA, MD, MT, NV, NH, PA, WA) require all participants' consent. VoiceAI provides automated disclosure prompts and compliance logging. Customers must configure appropriate disclosures for their jurisdiction.

AI Disclosure: Several states (including CA, FL, TX) require disclosure when a caller is interacting with an AI or automated system. Customers must configure their agents to disclose their AI nature when required by law. VoiceAI provides pre-call disclosure prompt templates for this purpose.

3. Acceptable Use

Customers may not use VoiceAI to:

  • Make unsolicited telemarketing calls to numbers on the National Do-Not-Call Registry
  • Make robocalls without prior express written consent where required by law
  • Use AI voice cloning to impersonate real individuals without their consent
  • Engage in deceptive practices (fake caller ID, spoofing, phishing via voice)
  • Harass, threaten, or defraud any person via automated calls
  • Make calls to emergency services (911) or healthcare emergency lines
  • Violate any federal, state, or local telecommunications law

Violation of these terms may result in immediate account suspension. See our Acceptable Use Policy for full details.

4. Data Processing & Subprocessors

VoiceAI processes customer data through the following subprocessors:

  • Twilio — Telephony infrastructure (call routing, SMS, phone numbers)
  • AssemblyAI — Speech-to-text transcription, voice agent processing
  • Supabase — Database hosting, authentication, file storage
  • Stripe — Payment processing and subscription billing
  • LLM Providers — OpenAI, Anthropic, Google, Groq, Mistral, and others (customer-configured)
  • Resend — Email delivery (call summaries, notifications)

Customer voice data (call audio, transcripts) is processed by AssemblyAI and the configured LLM provider. Data retention is controlled by the customer. See our Privacy Policy and Data Processing Addendum for details.

5. Accounts & Billing

Customers are billed monthly based on their selected plan. Plans include a fixed number of call minutes. Usage beyond plan limits is billed at $0.05–$0.10 per minute. Phone numbers purchased through the platform incur monthly fees. All fees are non-refundable except where required by law. Accounts more than 30 days past due may be suspended.

6. Intellectual Property

Customers retain all rights to their agent configurations, system prompts, knowledge base content, call recordings, and data. VoiceAI retains rights to the platform software, UI design, and infrastructure. Customer-uploaded content is processed on the customer's behalf and is not used to train our models.

7. Limitation of Liability

VoiceAI is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, call quality, or AI accuracy. We are not liable for indirect, incidental, or consequential damages including lost revenue, regulatory fines, or reputational damage arising from customer's use of the platform. Customer's sole remedy is a pro-rata refund of the current billing period.

8. Indemnification

Customer agrees to indemnify and hold VoiceAI harmless from claims arising from: (a) customer's violation of telecommunications laws, (b) customer's call content or agent behavior, (c) customer's failure to obtain required consents, (d) claims by call recipients regarding recording or automated calling, and (e) violation of these Terms.

9. Termination

Either party may terminate with 30 days' notice. VoiceAI may suspend service immediately for violations of the Acceptable Use Policy, fraudulent activity, or failure to pay. Upon termination, customer data is retained for 30 days then permanently deleted, unless legal retention is required.
